Some Queensland small businesses have had it tough during the COVID-19 pandemic.

And a number have struggled to pay rent.

While many small businesses have been able to come to a new rent agreement with their landlords, some have been unable to.

If you're one of these small businesses, you can seek assistance from the Queensland Small Business Commissioner's free mediation service to help you resolve disputes.

Mediation helps all parties explore their concerns and try to find a solution that works for everyone.

This way disputes can be resolved without the need to attend the Queensland Civil and Administrative Tribunal (QCAT) or take legal action through the courts.

It is often less stressful than you would think, because the mediator is there to help both parties find a solution.

The mediator does not provide legal advice and they do not adjudicate or arbitrate the dispute but they do offer an efficient and fair process where everyone has the chance to speak and be heard respectfully.

All parties are encouraged to come prepared and make a genuine attempt to reach an agreement.

This means:

  • outlining your position and what you want to achieve
  • providing relevant documents
  • being willing to listen and negotiate.

While mediation can be stressful for some, it is better if disputes are resolved quickly and amicably so everyone can get back to business sooner.

That's why it’s important to be open and honest about what you want and allow the mediator to guide you through the process.

In many cases an agreement can be reached.

And you'll sign a settlement agreement prepared by the mediator that outlines what both parties need to do.

But in the event an agreement can't be reached, you will need to seek further legal advice.

But remember, sometimes mediation takes patience and time, which is why your mediator is here to help.
