Retail shop leasing

Tenants, landlords and professionals involved in leasing retail shops need to be aware of government regulations on retail leasing:

  • The Retail Shop Leases Registry and Tribunal:

    • administers the Retail Shop Leases Act 1994 which outlines the basic rules on which retail shop leases are drawn
    • has developed a booklet called Retail leasing guidelines
    • administers a process for the resolution of retail tenancy disputes.

Retail industry associations can be a good source of information and advice:

  • National Retail Association

  • The Retailers Association 

  • Shopping Centre Council of Australia

  • Property Council of Australia
